Everstrong + Strong Foundations Client Service Agreement
Effective Date: 05/23/2026
This Client Service Agreement (“Agreement”) is entered into between Refinery Strength Collective, LLC (“Company,” “Coach,” “We,” or “Us”) and the undersigned participant (“Client,” “You,” or “Participant”).
By enrolling in, attending, or participating in Everstrong, Strong Foundations, or any group fitness services offered by Refinery Strength Collective, LLC, you acknowledge that you have read, understood, and agreed to the following terms:
1. Programs Covered
This Agreement applies to all group training services offered by Refinery Strength Collective, LLC, including but not limited to:
- Everstrong Membership
- Strong Foundations Cohorts
- Specialty workshops, educational sessions, and group programming
2. Eligibility
Participants must be 40 years of age or older unless otherwise approved in writing by Refinery Strength Collective, LLC.
Strong Foundations is specifically designed as a beginner-focused educational strength training cohort.
3. Payment & Billing Policies
3.1 Payment Required Before Participation
All memberships, classes, and cohorts must be paid in full before participation or scheduling.
No spot will be reserved without payment.
3.2 Membership Auto-Renewal
Everstrong memberships are:
- Month-to-month
- No long-term contract required
- Automatically renewed on the same calendar date each month
(Example: March 17 → April 17 → May 17)
By enrolling, Client authorizes recurring automatic payments using the payment method on file until membership is canceled according to this Agreement.
3.3 Unlimited Membership Access
Everstrong memberships include unlimited class attendance within the active membership period, subject to schedule availability and coach discretion.
4. Cancellation Policy
4.1 30-Day Written Notice Required
Membership cancellations require:
- A minimum of 30 days written notice
- Submitted via email or approved written communication method
Example:
If cancellation notice is submitted on March 10 and the billing date is March 17, the March 17 payment will still process, and membership will terminate effective April 17.
4.2 No Refunds
All payments are final and non-refundable.
This includes:
- Missed classes
- Unused memberships
- Early cancellation
- Partial months
- Schedule conflicts
- Dissatisfaction with results
No refunds, credits, or prorated adjustments will be issued under any circumstance except as required by law.
5. Attendance, Missed Classes & Membership Holds
5.1 Missed Classes
Clients are responsible for attending scheduled classes.
- Missed classes are forfeited.
- No make-up classes will be offered.
- No credits will be issued for missed or canceled attendance by the Client.
5.2 Membership Holds / Freezes
Memberships may not be paused, frozen, or extended.
Exceptions may be considered solely at the discretion of Refinery Strength Collective, LLC in cases involving:
- Medical emergencies
- Significant injury
- Other extraordinary circumstances
The length, terms, and eligibility of any approved hold are determined exclusively by Refinery Strength Collective, LLC.
6. Strong Foundations Cohort Terms
Strong Foundations is:
- A fixed-length cohort program
- Beginner-focused
- Educational in nature
Enrollment is reserved specifically for the scheduled cohort period and may not be transferred or extended outside the designated session dates.
Missed cohort sessions are forfeited and will not be rescheduled or refunded.
7. Coach Discretion & Schedule Changes
Refinery Strength Collective, LLC reserves the right, at its sole discretion, to:
- Modify class schedules
- Change training times
- Substitute coaches or instructors
- Adjust programming structure
- Change locations
- Limit attendance
- Revoke or deny participation for safety, behavioral, operational, or business reasons
Participation may occur at:
- Refinery Strength Collective’s private studio
- Third-party rented facilities
- Approved training spaces
The Company is not responsible for conditions, interruptions, or limitations caused by third-party facilities.
8. Weather, Emergencies & Facility Closures
Classes may be canceled, rescheduled, or modified due to:
- Weather conditions
- Facility issues
- Illness
- Emergencies
- Unsafe conditions
- Circumstances beyond Company control
Refinery Strength Collective, LLC reserves full discretion regarding operational decisions related to closures or cancellations.
Canceled classes due to weather or emergencies are not guaranteed to be rescheduled, credited, or refunded.
9. Health Disclaimer
Refinery Strength Collective, LLC is not a medical provider.
Services provided are intended for:
- General fitness
- Education
- Wellness support
They are not medical advice, diagnosis, treatment, or rehabilitation.
Client understands and agrees:
- Participation is voluntary
- Exercise involves inherent physical risk
- Client should consult a physician before beginning any exercise program
- Client assumes responsibility for communicating injuries, limitations, or medical concerns
10. Assumption of Risk & Liability Release
Client voluntarily assumes all risks associated with participation in physical activity, including but not limited to:
- Injury
- Illness
- Falls
- Equipment failure
- Muscle strain
- Cardiovascular events
- Aggravation of pre-existing conditions
To the fullest extent permitted by law, Client releases and holds harmless:
Refinery Strength Collective, LLC, its owner(s), coaches, employees, contractors, landlords, and representatives
from any claims, damages, injuries, losses, or liabilities arising from participation in services.
This applies to:
- In-person training
- Virtual instruction
- Home workouts
- Third-party facilities
- Any assigned programming
11. No Guaranteed Results
Client understands:
- Individual results vary
- No specific outcome is guaranteed
Refinery Strength Collective, LLC makes no guarantees regarding:
- Weight loss
- Fat loss
- Strength gains
- Muscle growth
- Pain reduction
- Hormonal improvement
- Physical appearance
- Health outcomes
Results depend on many factors outside the Company’s control, including consistency, nutrition, sleep, stress, medical history, and lifestyle.
12. Conduct Policy (Zero Tolerance)
Refinery Strength Collective, LLC is committed to maintaining a respectful, safe, and encouraging training environment.
The following behaviors are strictly prohibited:
- Disruptive behavior
- Drama or repeated interpersonal conflict
- Harassment or intimidation
- Unsafe lifting practices
- Disrespect toward coaches or members
- Repeated lateness
- Behavior negatively impacting group culture
Refinery Strength Collective, LLC maintains a zero-tolerance policy.
Membership or participation may be immediately revoked at the sole discretion of the Company without warning, refund, or credit.
13. Photography, Video & Social Media Release
By participating, Client grants Refinery Strength Collective, LLC permission to capture and use:
- Photos
- Videos
- Testimonials
- Audio recordings
for:
- Marketing
- Social media
- Educational materials
- Promotional content
If Client wishes to opt out of media usage, written notice must be submitted prior to participation.
14. Communication Expectations
Clients are expected to:
- Maintain respectful communication
- Read scheduling updates and announcements
- Arrive prepared and on time
- Follow safety instructions provided by coaches
Business communications will occur during standard business hours unless otherwise stated.
15. Governing Law
This Agreement shall be governed under the laws of the State of Iowa.
Any disputes arising under this Agreement shall be handled in the appropriate courts located within Iowa.
16. Entire Agreement
This Agreement represents the complete understanding between the parties and supersedes all prior discussions, representations, or agreements.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
