Giveaway Winner Agreement

Effective Date: 12/08/2025


This Giveaway Winner Agreement (“Agreement”) is entered into between Refinery Strength Collective, LLC(“Company,” “Coach,” “We,” or “Us”) and the undersigned giveaway winner (“Winner,” “You”).
By accepting a giveaway prize from Refinery Strength Collective, LLC, you agree to the following terms and conditions:


Section 1: Giveaway Prize Options

1. Giveaway Prize Options

The Winner may select one (1) of the following giveaway prizes, subject to availability and approval by Refinery Strength Collective, LLC:

Option A: In-Person Training

  • One (1) month of in-person personal training
  • Includes four (4) 1-hour sessions
  • Sessions must be scheduled and completed within 35 days of the agreed-upon start date

Option B: Virtual Coaching

  • Six (6) months of virtual coaching
  • Includes monthly programming and check-ins based on the virtual coaching tier assigned by the Company
  • Services are delivered remotely and do not include in-person sessions
Refinery Strength Collective, LLC reserves the right, at its sole discretion, to modify, substitute, revoke, or discontinue any giveaway prize, or to adjust prize details, if necessary. Any changes to the prize or delivery of services may be agreed upon by both parties prior to the start of services.
Once services have begun, prize selections and terms may not be changed.


2. No Cash Value / Non-Transferable

  • Giveaway prizes have no cash value and may not be sold, transferred, exchanged, or redeemed for cash or other services.
  • Prizes are valid only for the named Winner.


3. Scheduling & Expiration

In-Person Training

  • Sessions must be scheduled in advance and completed within the stated timeframe.
  • Missed or unused sessions expire and are forfeited.
  • Sessions do not roll over or extend beyond the giveaway period.

Virtual Coaching

  • Programming and coaching are provided monthly for six consecutive months.
  • Services are not paused, extended, or prorated due to non-participation, travel, illness, or scheduling conflicts.


4. No Refunds or Substitutions

Because this prize is provided at no cost:
  • No refunds, credits, or substitutions will be issued for unused or missed services.
  • No extensions will be granted unless approved solely at the discretion of Refinery Strength Collective, LLC.


5. Health & Medical Disclaimer

Refinery Strength Collective, LLC is not a medical provider and does not diagnose or treat medical conditions.
Winner acknowledges that:
  • Participation in fitness coaching is voluntary.
  • You are responsible for consulting with a physician prior to beginning any exercise program.
  • You assume full responsibility for your health and physical condition during participation.

Paragraph

6. Assumption of Risk & Liability Release

By accepting and participating in the giveaway prize, Winner voluntarily assumes all risks associated with physical activity, including injury, illness, or adverse health events.
Winner agrees to release, indemnify, and hold harmless Refinery Strength Collective, LLC, its owners, coaches, contractors, and representatives from any claims, damages, or liabilities arising from participation in coaching services, whether in-person or virtual.


7. Conduct & Participation

Winner agrees to:
  • Communicate respectfully and professionally.
  • Follow coaching instructions and safety guidelines.
  • Maintain appropriate behavior during sessions and communications.
Failure to do so may result in termination of the giveaway prize without compensation.


9. Governing Law

This Agreement shall be governed by the laws of the State of Iowa.


10. Entire Agreement

This Agreement represents the complete understanding between the parties regarding the giveaway prize and supersedes any prior communications.
