I AM AWARE ANO UNDERSTAND THAT PARTICIPATION IN ANY ACTIVITY IS POTENTIALLY DANGEROUS AND INVOLVES THE RISK OF PERSONAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING. TEMPORARY OR PERMANENT DISABILITY. DEATH. PROPERTY DAMAGE. AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY ANO VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED ANO HEREBY AGREE TO ACCEPT ANO ASSUME ANY AND All RISKS OF INJURY INCLUDING, BUT NOT LIMITED TO, FALLS, PREGNANCY LOSS, CONTACT WITH OTHER PARTICIPANTS, THE EFFECTS OF THE WEATHER, INCLUDING HIGH HEAT ANO/OR HUMIDITY, DISABILITY, DEATH AND/R PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF COMPANY OR OTHERWISE.

I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in any Activity. I acknowledge that I am physically fit and mentally capable of performing the Activity I choose to participate in.

I hereby expressly waive and release any and all claims, now known or hereafter known, against Company and its officers, directors, managers, employees, agents, affiliates, members, successors, and assigns (collectively "Releasees") on account of injury, disability, death, or property damage arising out of or attributable to my participation in any Activity, whether arising out of the ordinary negligence of Company or any Releasees or otherwise. I covenant not to make or bring any such claim against Company or any ,other Releasee, and forever release and discharge Company and all other Releasees from liability under such claims. Nothing herein purports to release any claims for gross negligence or willful and wanton misconduct. I further covenant and agree to indemnify and hold harmless Releasees from any loss, liability, damage, or costs, including attorney's fees and court costs, that may incur arising out of related to my participation in any Activity and any negligent act of Releasees, including as a result of negligent rescue operations. It is my express intent this waiver and release of liability binds my family members, spouse, heirs, assigns, personal representatives, and anyone else ,entitled to act on my behalf to the extent they act on my behalf, and is deemed as a release, waiver, discharge, and covenant not to sue the Releasees.

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in any Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless Releasees from any claim based on such treatment or other medical services.

This Release of Liability and Assumption of Risk constitutes the sole and entire agreement of Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is deemed by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release. All matters arising out of and relating to this Release shall be governed and construed in accordance with the laws of the State of Iowa without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Polk County, Iowa and I hereby consent to the exclusive jurisdiction of such courts. I hereby grant Refinery Strength Collective, LLC ("Company"), its representatives, and employees the right to take photographs and/or videos of me during my participation in any Activity. I authorize Company to use, publish, or distribute these photos/videos for any lawful purpose, including but not limited to social media, marketing, promotional materials, advertising, and website content, without any additional compensation or further approval. I understand that all such materials will remain the property of Company. I, the undersigned, hereby hold harmless, waive and release Refinery Strength Collective, LLC, their childcare workers, officers, representatives, agents, organizers and successors from liability as a result of personal injury or property damage occurring while my child/children are provided only while I am within a 2-mile radius. I have read, understand and agree to adhere to the childcare policies and procedures of Refinery Strength Collective, LLC listed above.

The undersigned hereby assumes all risk of injury or harm as a result of the activities specified above and agrees to release, indemnify, defend, and forever discharge the release from all liability, claims, demands, damages, costs, expenses, and causes of action due to death, injury, loss, or damage to the undersigned. BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY. *
